Constitution and Bylaws

The bylaws of each local union, with the UAW Constitution, set out the rules by which the local operates. In a new local, the work of this committee sets the stage for how the local will function. But, even well established locals may need to modify or amend their bylaws.

Members of this committee are responsible for submitting original and/or amended bylaws provisions to the local union membership for discussion and approval. This committee monitors the required local union bylaws amendment procedure to ensure compliance with the current bylaws and constitutional provisions.

By-Laws

ARTICLE I ORGANIZATION

 

This organization shall be known as Amalgamated Local 723 International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW).

 

Section 1

 

Representing the following: Caravan Knights, Chrysler Dundee Engine Plant (DEP), Devon, Ford River Raisin Warehouse (RRW), Frenchtown Fireman Association (POC), Gerdau, Monroe County Friend of the Court, Yanfeng Plant 1 & 2,  Neapco, and Syncreon here and after referred to as units.

 

ARTICLE II

 

The By-laws of this amalgamated local union, here after referred to as a local union shall be in all respects subordinate to the UAW Constitution and all applications and interpretations thereof.

 

ARTICLE III OBJECTIVE

 

Section 1

 

To improve working conditions for its members, better their general economic welfare, and to establish a living wage in accordance with the desires of the membership.

 

Section 2

 

To unite its members into one organization of regardless of race, religion, color or creed, political affiliation or nationality, age, handicap, marital status or sexual orientation.

 

Section 3

 

To educate its members in the meaning of true Americanism and to develop and maintain an intelligent and dignified membership.

 

ARTICLE IV MEMBERSHIP

 

Every member in good standing, of each unit, of this local union, has the right to nominate and vote, express opinions on all subjects before the local union, to attend all General membership meetings and express views, arguments and opinions on all matters and business including candidates for office, to meet and assemble freely with other members and generally to participate in the activities of the local union in a responsible manner consistent with good conscience in order to present and discuss factually and honestly the issues upon which the membership must base its decision.  These rights shall at all times be subject to the rules and regulations contained in the Constitution, Local By-Laws and other official rules of the U.A.W.

 

A member, in exercising the foregoing rights and privileges, shall not take any irresponsible action which would tend to jeopardize or destroy or be detrimental to either the Local or International Unions as organizations, or their free democratic heritage, or which would interfere with the performance f the local union or the International Union.  Violation or abuse of these rights and privileges of membership, or engaging in conduct unbecoming a Union member, could result in disciplinary action.  The membership shall strive to obtain the objectives set forth in the International Constitution and additional objectives as established as the policy of the International Union; to maintain free relations with other organization; to do all in its power to strengthen and promote the labor movement; to cooperate with regional board members and the International Representatives to help promote organizational activities.

 

 

 

 

ARTICLE V  AUTHORITY

 

Section 1

 

The highest authority of the local union shall be vested in the general membership meeting, to be called at least once each month, except that the general membership meetings may be postponed by order of the general membership when a regularly scheduled meeting would conflict with a holiday or would otherwise be inconvenient to the membership.

 

(A) A unit of an amalgamated local union may hold membership meetings quarterly if said unit has presented and received approval from a general membership meeting.(subject to art. 37 section 4 of the International Uaw Constitution)

 

Section 2 Quorum

 

Twenty members, excluding officers, in good standing shall constitute a quorum for the transaction of business at a regular or special meeting.

 

(A)  Each unit of this amalgamated local union may set its own quorum for unit membership meetings.

 

Section 3

 

Special membership meetings may be called by any unit of the local when deemed necessary or by the local union Executive Board.  It shall be the duty however, of the local union Executive Board or the President of the local union to call a special meeting upon the petition of fifty (50) members in good standing.

 

Such meetings shall be called within seven (7) days of receipt of the petition.  Seventy-two (72) hours notice shall be considered sufficient, except that with special meetings called involving any strike action, a twenty-four notice shall be considered sufficient.  No other business other than that stated in the petition shall be considered or discussed.

 

Section 4

 

As it pertains to the Dundee Engine Plant/Chrysler LLC Unit, Skilled Trades members may hold their own meetings to discuss and act on problems and issues concerning the Skilled Trades Department.  Minutes of all Skilled Trades meetings shall be read and acted upon at the next regular DEP Unit meeting. Ten (10) members in good standing shall constitute a quorum for the transaction of business at a Skilled Trades meeting.  The Skilled Trades will determine the frequency of their Skilled Trades meetings.

 

Section 5

 

Any member being recognized by the chair for the purpose of making a motion must stand before speaking and must clearly state his/her full name, and unit for clarification of the record.

 

 

Section 6

 

If a member, while speaking, is called to order, he/she at the request of the chair, shall take his/her seat until the question has been declared

 

Section 7

 

The chair shall clearly repeat to the meeting all motions and amendments duly made and seconded, and thereon the motion or amendment shall be subject to debate.  The chair shall again repeat the motion or amendment immediately prior to any voting action.

 

Section 8

 

The time limit on each item is to be three (3) minutes per person.  No one person to speak more than twice on any one subject.  Meeting chairperson to call time when chairperson sees fit. 

 

Section 9

 

After the meeting is called to order, no one is to leave the meeting without the permission from the chair.

 

Section 10

 

The regular order of business outlined in Article 42 of the International Constitution shall be the order of business at all regular membership meetings.

 

Section 11

 

No meeting is to exceed two (2) hours unless otherwise approved by the body.

 

Section 12

 

Any member who attends a meeting in an intoxicated condition, creates a disturbance, becomes unruly, or uses obscene or offensive language shall lose voice and his/her right to vote at said meeting.  Where necessary to maintain order, the member may be evicted from the meeting, by order from the chairperson and subject to challenge by the membership.  Flagrant or persistent violation of this section by any member shall be conduct unbecoming a Union Member.

 

Section 13

 

Questions of parliamentary nature shall be decided by Roberts Rules of Order.

 

Section 14

 

Between membership meetings, the Executive Board shall be the highest authority of the local union and shall be empowered to act on behalf of the membership of each unit to the extent urgent business requires prompt and decisive action, subject to subsequent membership approval of each unit, but the Executive Board may not take action affecting the vital interests of the amalgamated local union without prior membership approval.

 

(A) As per article 35 Section III-C paragraph 1 of the UAW Constitution.

 

Section 15

 

Between meetings of the Executive Board, the President shall exercise general administrative authority and, shall be empowered to act on behalf of each unit, and take action permitted, to the Executive Board subject to subsequent approval of the Executive Board.

 

Section 16

 

No special meetings shall delay or supersede the general membership meeting as called by the Local Executive Board.

 

ARTICLE VI AMALGAMATED LOCAL UNION OFFICERS AND UNIT REPRESENTATIVES

 

All units of the local union shall elect the following Executive Officers:  President, Vice-President, or Vice-Presidents, Financial Secretary-Treasurer, Recording Secretary, three (3) Trustees’, Sergeant-At-Arms, and Guide.

The local union Executive Board shall consist of the Elected Officers and the elected Chairperson of each unit of the amalgamated local union along with a member of the Retiree’s chapter of Local 723. The three Trustees shall elect a Chairperson among themselves. All further matters concerning units of the local union shall adhere strictly to the UAW Constitution, as per article 35.

 

Section 1

 

Nominations and election of Officers, Election Committee and Union Representatives

 

The Election Committee shall be nominated and elected at the regular membership meeting, or special meeting called for that purpose no later than the December before the Triennial Election year and serve for three (3) years.  The candidate receiving the highest number of votes will serve as the Election Committee Chairperson.  Since nominations and election of the Election Committee takes place at the same meeting it shall be necessary for all candidates to the committee to be present at such meeting to accept or decline nomination or submit, in writing to the Recording Secretary prior to such meeting, their willingness to accept the nomination and be a candidate.

 

The Election Committee shall be large enough in number to facilitate elections at the unit’s site, thus utilizing two members per site.  At least one member from each site election committee shall be from the home unit.  Retiree’s will vote at the Union Hall, requiring two Election Committee Members at that site.

 

If additional election committee members are needed during the three (3) year election cycle, normal election guidelines will be utilized to fill those positions.

 

If the plant site cannot host the election, a suitable site in proximity with the plant will be selected by the Election Committee Chairperson and the Executive Board.  The ballots shall be machine or hand counted at the Union Hall.  All ballots will be returned to the Union Hall in the locked boxes from each location by both Election Committee Members.

 

Section 1-A

 

(A) Election Committee members will serve two (2) days on General elections and two (2) days on Special Elections.

 

(B) Rate of pay to be actual and necessary lost time not to exceed the amount which the members would otherwise have received from his/her employer, for the same period of time for which he/she is being compensated by the local union.  This by-law is not to supersede Article X, Section 5 of the by-laws.

 

Section 1-B

 

When necessary, any Local 723 Special Election(s) will be conducted at the same locations, or reasonable alternative provided by the Local President, as prescribed in these bylaws as the Tri-Annual Election.

 

 

Section 2

 

Nominations of Local Officers and Elected Unit Representatives shall take place at the regular membership meeting, or special meeting called for that purpose in April of the election year.  An eligible member who has been nominated for local union office shall have seven (7) days from the date of that members’ nomination to accept or decline, in writing on the official acceptance form.  If the meeting occurs on a weekend, the seven-day period will be extended until 4:00 PM on Monday. This form will also state the proper way a nominee wishes his/her name to appear on the ballot.

 

Section 3

 

Any member shall be eligible as nominee and candidate for any elective office or position in this local union, who has been a member in good standing for a period of one (1) year immediately prior to his/her nomination, except that he/she may not be a candidate for more that one (1) Executive Office.  Any member in good standing who has transferred to this local union from another local union, as a result of transfer of operation to the terms of a UAW Collective Bargaining Agreement, shall be considered as having continuous good standing in this amalgamated local union for the purpose of this section.

 

(A) The Election of Local Officers and Elected Unit Representatives shall take place, by the use of voting machines, paper ballots, and/or computer systems, during the months of May or June of each election year and the installation of Local Officers and Elected Unit Representatives shall take place at the next regular membership meeting except as authorized by the International Union.

 

(B) These Local Officers and Elected Unit Representatives shall serve for the period of three (3) years.

 

 (C) All Local 723 Local Officers and elected Unit Representatives will be elected by a majority vote only.

 

 

 

Section 4

 

After the deadline on accepting nominations has expired, no election of so-called “sticker” or “write-in” candidates shall be considered legal.

 

Section 5

 

Every member in good standing shall be entitled to nominate and vote in all Local Union Elections in his/her respective unit elections.

 

Section 6

 

Any eligible candidate in any election shall have the right to submit his/her commonly known name to the Election Committee in writing as he/she desires it to appear on the ballot and it shall so appear.

 

Section 7

 

All local election literature used in Local Elections must be approved by the Election Committee who shall handle all details insofar as they relate to the procedure of the election and adopt such safeguards as are necessary to insure a fair election.

 

Section 8

 

No candidate in any election shall be member of the Election Committee having supervision over such election.

 

Section 9

 

The Election Committee shall have the specific responsibility of making and handling of all ballots.  Any ballot which clearly indicates the intention of the voter shall be considered valid.

 

 

Section 10

 

If any Elected Representative of any unit of the local union shall resign, be recalled or vacate his/her position a person shall be appointed by the Unit Chairperson to fill the vacancy for a period not to exceed thirty (30) days, during which time an election shall be held to fill the vacancy.

 

Section 11

 

(A) Each candidate shall have the right to have one (1) challenger present when the votes are cast and when they are tabulated, provided the units of the amalgamated local union shall assume no expense by the provision.

 

(B) A candidate running for office must submit the name of their challenger, in writing, to the election committee chairperson before the polls open.  This must be signed by the candidate.

 

Section 12

 

No one except the election committee, challengers and those voting or who are waiting to vote shall be allowed in the place designated as a voting place for the election.

 

Section 13

 

Voters who have cast their ballots shall not be allowed to loiter in the voting place.

 

Section 14

 

No member shall be permitted to simultaneously run for or hold more than one (1) of the following offices:  President, Vice-President, Financial Secretary-Treasurer, Recording Secretary, Trustee, Sergeant-At-Arms, and Guide.

 

Section 15

 

All elections of local union Officers and delegates to the International Convention shall be by secret ballot, except the units of an amalgamated local where they will be subject to the UAW Constitution.  In the event of a tie vote a run-off election will be held, per Article 8 Sections 5, 6, and 7.

 

Section 16

 

Any member convicted of misrepresenting returns, altering, mutilating or destroying deposited ballots, voting fraudulently or of intimidating others by threats or otherwise interfering with a member in the exercise of his or her right to cast his or her ballot in any amalgamated local union elections and strike balloting, shall be punished in accordance with the Constitution of the International Union.

 

Section 17

 

A member of the Local Union’s Retiree Chapter shall be a member of the amalgamated local union Executive Board, with a voice and vote.

 

ARTICLE VII DUTIES OF OFFICERS

Section 1 Duties of the President:

 

(A) The President shall see that the Committees are actively engaged in carrying out their respective programs and to report to the general membership of the inactivity of any of the committees of all units.

 

(B) Between sessions of the Local Executive Board, the President shall carry out the instructions of the Local Executive Board and shall have full authority to direct the working of the local union with the provisions of the International Constitution and the local union By-laws and shall report his/her acts to the Local Executive Board.

 

(C) President may have the privilege to sit in on any negotiation session with the Bargaining Committee and the Company; President shall take time off for Union business whenever it is deemed necessary for the betterment of the Union, but shall furnish proof of lost time and expense to be accepted by the Executive Board and the membership.

 

(D) The president shall be actively engaged in attending outside Union activities and be responsible for all committees pertaining to Union and Social functions.

 

Section 2 Duties of the Vice President

 

The Vice-President shall assist the President in the discharge of his/her duties and shall perform the duties of the President in his/her absence, death, incapacity or resignation from office.

 

Section 3 Duties of the Financial Secretary-Treasurer

 

(A) All Financial matters pertaining to units of the amalgamated local union shall adhere to the UAW Constitution, Article 40 Section 4.

 

(B) It shall be the duty of Financial Secretary-Treasurer to receive all dues, initiation fees, readmission fines and all other income of the local union for any fund and to give official receipt for same. The Financial Secretary-Treasurer is to assist the Unit Chairperson in processing and expediting grievance procedures.

 

(C) He/she shall write all checks drawn on the local union funds and report in writing every month, at a regular meeting of the local union, giving the amount of money received and paid out during the previous calendar month divided as between the various income and expenditures classifications and the remaining balance in the fund accounts of the amalgamated local union.

 

(D) He/she shall deposit all collections in such bank as local union Trustees may direct.

 

(E) He/she shall perform all other duties as outlined in the Constitution of the International Union.

 

(F) He/she shall arrange for all transportation and accommodation needs for members attending conventions or other authorized Union business which requires them to remain overnight.

 

Section 4 Duties of the Recording Secretary

 

It shall be the duty of the Recording Secretary to keep a correct record of the proceedings of each unit of the local union, sign all orders on Financial Secretary –Treasurer authorized by the local union, read all documents and conduct the general correspondence received by the local union which does not pertain directly to the duties of other officers of the other units of the local union and keep same on file for future reference.  He/she shall bring to the attention of the membership of that unit of the local union any correspondence upon which the membership must take action.

 

Section 5 Duties of Trustees

 

All Trustees are to meet each month at the local union Hall, to transact any and all Union business under their jurisdiction. They shall see that the President and the Financial Secretary-Treasurer are properly bonded in accordance with recommendation of the International Union.

 

Section 6 Duties of the Unit Chairperson

 

To receive complaints and grievances in the shop and make every effort, in conformity with the grievance machinery, to satisfactorily adjust and settle all grievances.

 

(A) The Unit Chairperson is to be responsible for all Unit Representatives.

 

(B) No Unit Representative is to leave the plant except on Union business and must be certified by the Unit Chairperson.

 

(C) Disposition of all second and third stage grievances to be posted as soon as possible.

 

(D) Any member not satisfied with actions or decisions of his/her representation in connection with a grievance concerning him/her, may appeal such action or decision to the Unit Chairperson of their respective units.  If not satisfied with the Unit Chairperson’s decisions, he/she can then appeal to the membership at the next unit membership meeting.  Appeals may be made beyond the membership in accordance with the provisions outlined in the International Constitution.

 

(E) Any person dissatisfied with the action or decision of the local union or any representative thereof, other than the action or decision of the membership of the local union shall take his/her appeal or complaint to the local union Recording Secretary within sixty days as permitted by Article 33 of the International Constitution.

 

(F) The Executive Board shall refer the matter to the Bargaining Committee (or Stewards Council) if it involves collective bargaining.  Otherwise the Executive Board shall consider the matter itself.

 

(G) Whichever of these bodies the matter is referred to shall consult with the grievant and permit him/her full opportunity to be heard, and shall reach a decision.

 

(H) Within thirty (30) days of receiving a notice of such a decision, the grievant if wishing to appeal further, shall submit his/her appeal to the Recording Secretary in writing for consideration at the earliest possible membership meeting. 

 

(I) Appeals may be made beyond the membership in accordance with the provisions outlined in the International Constitution, Article 33.

 

Section 7 Bargaining Committees and Unit Representatives

 

(A) Unit Bargaining Representatives may be recalled by the members he/she represents for failure to perform duties of his/her office.  A valid petition setting forth specific complaints of the Unit Representatives. Committeeperson’s failure to perform the duties of his/her office shall be signed by fifty percent (50) of the members he/she represents at the time of the petition is filed with the Recording Secretary.  The Unit Representative so complained against shall receive notification of the specific complaints prior to any meeting for the purpose of recall.  Upon the filing of a valid position with the amalgamated local union, a special meeting for recall shall be held, after due notification of at least seven (7) days is given to all parties concerned.  Fifty percent (50%) of the members represented by the Unit Representative complained against shall constitute a quorum at such meetings and it shall require a two thirds (2/3) vote of the members present to recall.

 

(B) Unit Bargaining Representatives will be elected according to these by-laws and/or each unit’s respective contracts.

 

 

(C) Election for the Gerdau MACSTEEL Unit Bargaining Committee (UBC) and Crew Stewards shall be conducted as follows:

 

The Unit Chairperson’s office:  All members are eligible to run and vote for the Unit Chairperson’s position.

 

At the time of nominations candidates for the Unit Bargaining Committee (UBC) must be assigned to work in the following department to accept a nomination from that area.

 

1.     Melt Shop.

2.     Rolling Mill.

3.     QA/Stores/Shipping/Processing.

4.     Maintenance.

 

Three (3) Production Union Bargaining Committee Representatives shall be                         elected Plant wide by the entire membership. 

 

One (1) maintenance Union Bargaining Committee Representative shall be elected Plant wide by the entire membership.

 

One additional maintenance Steward shall be elected plant-wide by the entire maintenance membership.

 

One additional Shipping/Processing Steward shall be elected plant-wide by the entire Shipping/Processing membership.

 

Four (4) Production Stewards shall be elected by the respective production membership on the established production crew i.e. “A” crew eligible to vote for “A” crew, “B” crew eligible to vote for B crew etc.  One (1) maintenance steward shall be elected by the plant wide maintenance membership. One (1) Shipping/Processing steward shall be elected by the Shipping Processing department membership.

 

(D) The Ford River Raisin Warehouse (RRW) unit shall elect their bargaining committee according to their present by-laws and/or contract.  The Bargaining Committee will be elected by the following procedure:  One (1) Building Chairman will be elected.  All members eligible to run and vote for the Unit Chairperson’s position.

 

(E) As it pertains to the Dundee Engine Plant/Chrysler LLC Unit, shall elect their bargaining Committee persons according to their present contract and/or bylaws.  Bargaining Committee persons will be elected by the following procedures:  Two (2) Bargaining Committee persons will be elected, One (1) Skilled Trades Bargaining Committee person and One (1) Production Bargaining Committee person.

 

The Production Bargaining Committee person will be a dayshift position and will be elected by all production shifts/crews on a separate ballot.  Any Production members may run for this position.

 

The Skilled Trades Bargaining Committee person will be a dayshift position and will be elected by all Skilled Trades employees assigned to the Skilled Trades Department on all shifts/crews on a separate ballot.  Any Skilled Trades member assigned to the Skilled Trades Department may run for this position.  Skilled Trades voting procedure may only be altered by a majority vote of the Skilled Trades.

 

Two (2) Stewards and no more than 4 Alternate Stewards shall be elected. One (1) Steward and two (2) alternates for the dayshift and One (1) Steward and two (2) Alternate Stewards for the afternoon shift. Each steward position will be “Crew Specific” elected positions, meaning each crew will vote for their own representative.  Anyone running for a Steward position must currently be on the shift they are running to represent.

 

The Unit Chairperson will be an “at large” elected position and will serve on the first shift consistent with the contract.

 

(F) Election of the Syncreon Unit Union Representatives:

 

One (1) Plant Chairperson shall be selected by the entire membership of the Bargaining Unit.

 

At the time of nominations, candidates for the Chief Stewards must be assigned to work on the crew where the open position exists.

 

Each Crew will be represented by a Chief Steward they shall be Crew specific.  Each crew will vote for their own crew Representative.  Any member in good standing can run for crew Representative.

 

(G) Election of Frenchtown Fireman Association (POC) Union Representatives:

 

All members in good standing within the Frenchtown Fireman Association Bargaining Unit are eligible to run and vote for the Chairperson’s position.

 

Five (5) Bargaining Committee persons shall be elected by the entire membership of the Bargaining Unit.

 

The Bargaining Committee shall consist of one Chief Steward and a Steward from each station.

 

(H) Election of the Yanfeng Plant 1 & 2 Union Representatives:

 

One (1) Chairperson for each building (1&2) shall be elected by their respective plant membership.

 

At the time of nominations, candidates for Building Chairperson must be assigned to work in the building where the open position exists.

 

Each building will be represented by a “Chairperson who shall be building specific.”  The membership from each building will vote for their specific Chairperson.

 

The “Bargaining Committee” from each building (1&2) shall consist of the chairperson and two (2) Bargaining Committee Representatives.

 

Each building will be represented by a “Bargaining Committee who shall be building specific.”  The membership from each building will vote for their specific Bargaining Committee.

 

Each building (1&2) will be represented by a “shift Stewards who shall be building specific.”  The membership from each building will vote for their specific shift Stewards.

 

(I) Election of Caravan Knights Union Representatives:

 

All members in good standing within the Caravan Knights Bargaining Unit are eligible to run and vote for the Chairperson’s position.

 

One (1) Plant Chairperson shall be selected by the entire membership of the Bargaining Unit.

 

At the time of nominations, candidates for the Chief Stewards must be assigned to work on the crew where the open position exists.  Each crew will vote for their own crew Representative.

 

(J) Election of Devon Union Representatives:

 

All members in good standing within the Devon Bargaining Unit are eligible to run and vote for the Chairperson’s position.

 

One (1) Plant Chairperson shall be selected by the entire membership of the Bargaining Unit.

 

At the time of nominations, candidates for the Chief Stewards must be assigned to work on the crew where the open position exists.  Each crew will vote for their own crew Representative.

 

(K)

 

Election of the Monroe County Friend of the Court Union Representatives:

 

All members in good standing within the Monroe County Friend of the Court Bargaining Unit are eligible to run and vote for the bargaining positions.

 

One (1) Chief Steward shall be selected by the entire membership of the Bargaining Unit.

 

Two (2) Committeepersons shall be selected by the entire membership of the bargaining unit.

 

One 12) Alternate Committeeperson shall be selected by the entire membership of the bargaining unit.

 

(L) Election of the Neapco Unit Union Representatives:

 

All members in good standing within the Neapco Unit are eligible to run and vote for the Chairperson’s position.

 

One (1) Plant Chairperson shall be selected by the entire membership of the Bargaining Unit.

 

At the time of nominations, candidates for Bargaining Committeeperson(s) must be assigned to work on the shift where the open position exists.

 

Each shift will be represented by a Bargaining Committeeperson who shall be shift specific.  Each shift will vote for their own shift Representative.

 

The above by-law shall in no way conflict with the International Constitution.

 

ARTICLE VIII ATTENDANCE RULES

 

It shall be mandatory that all members holding an elective or appointed office or position in this Local attend at least two regular General Membership meetings in every calendar quarterly period during their term in office.  It shall be mandatory that all Executive Officers of this local attend the same proportionate number of Executive Board meetings in addition to the regular membership meetings.  All elected officials shall be required to attend two (2) out of three (3) of any educational classes instituted by membership action.  Educational classes must relate to the officer’s respective position.  Failure to comply with these attendance rules could result in immediate removal from office of the offender.  Excuses for non-attendance must be accepted by the Executive Board at their regularly scheduled meetings.

 

Any member so removed, except as delegate to the International Constitutional Convention, from office shall not be eligible to run for any elective position for the remainder of the term of the office from which he/she was removed.

 

That the chairperson of each of the mandatory committees abide by the same attendance rules as the elected officers, and the committeeperson.  Violation of this by-law will mean removal from said committee by the President and said person will not be allowed to serve on any committee for at least one (1) year.

 

ARTICLE IX STANDING COMMITTEES

 

The local union shall have the following standing committees: Constitution and By-laws, Union Label, Education, Conservation and Recreation, Community Services, Civil Rights, Citizenship and Legislative, Consumer Affairs, Veteran’s, A Women’s Committee (where such membership exists), and other committees as may be deemed desirable and to the best interest of the Local when the need arises.  These committees shall be appointed by the President, subject to the discretion of the amalgamated local union membership.  Also added to this is that Local 723 provide a CAP Council Community Action Program Council, in accordance with the International instructions, Section 3.

 

ARTICLE X FINANCES

 

Section 1

 

All new members shall be required to pay an initiation of Fifty dollars ($50.00).  Thirty dollars ($30.00) of this initiation will go directly into the Building Operation Fund.  A Reinstatement fee shall be the regular initiation fee of fifty dollars ($50.00) plus the equivalent three (3) months dues.

 

 

Section 2

 

The Executive Board shall have the authority to make disbursements of local union funds, not to exceed two thousand ($2000.00) in any single disbursement or transaction.  It shall have the power to direct payment of ordinary bills and expenses of the local union.

 

Section 3

 

(A) All expenses pertaining to each unit will be governed by these by-laws.

 

(B) Any member called out of town for one or more day(s) on Union business shall be allotted the daily expenses, equivalent to what is paid by the International Union, (current daily per diem is $46 per day with $20 on the day of return).  Mileage while on official Union business shall be paid at the rate equivalent to what is paid by the International Union (current rate is $.54) per mile.  Distance will be governed by information obtained from AAA of Michigan.  Members driving on Union Business, if driving together, only the drivers shall be paid mileage.  To and from airport shall be paid, and parking shall be paid.  Personal phone calls up to ten ($10.00) dollars per day of use, and all business related calls per person shall be paid.

 

(C) Any member attending conventions or other authorized Union business which requires them to remain overnight shall be allotted an amount equivalent to what is paid by the International Union for day for expenses plus transportation, an amount not to exceed coach air fare, or mileage which shall be paid at a rate equivalent to what is paid by the International Union per mile, whichever is more economical, and accommodations arranged by the financial secretary.

 

(D) All payments for hotel/motel rooms must be supported by the original hotel/motel invoice showing the daily cost of the room, daily charges to the room and the name of the member using the room.  Payments for airline tickets must be supported by the third copy of the airline ticket even if the airline ticket is purchased by the Local Union through a travel agent.

 

(E) If it is determined to be more economical to arrange for a member or officer to travel earlier than their scheduled date of arrival for any conferences or sub-councils the Local may do so by paying the extra hotel/motel and per diem to the delegate.

 

Section 4

 

1.  Local union Executive Officers expenses shall be paid at the following monthly rate: Vice-President, $60.00; Recording Secretary, $80.00; Trustees, $60.00; Guide, $60.00; Sergeant-at-arms, $60.00; The office of the President and Financial Secretary-Treasurer shall be paid sixty-two ($62.00) dollars per week expenses.

 

Chairpersons, Bargaining Committeepersons, District Committeepersons/Stewards shall be paid expenses at the following monthly rates:

 

In units of less than 50 members: Chairperson of the Bargaining Committee, $10.00.

In units of more than 51 and less than 250 members: Chairperson of the Bargaining Committee, $40.00; Bargaining Committeepersons, $20.00; District Committeepersons/Stewards, $12.50.

In units of more than 251 members but less than 500 members: Chairperson of the Bargaining Committee, $75.00; Bargaining Committeepersons, $40.00; District Committeepersons/Stewards, $25.00.

In units of more than 501 but less than 1000 members: Chairperson of the Bargaining Committee, $150.00; Bargaining Committeepersons, $75.00; District Committeepersons/Stewards, $50.00

In units of greater than 1001 members:  Chairperson of the Bargaining Committee, $250.00; Bargaining Committeepersons, $120.00; District Committeepersons/Stewards, $80.00.

To be eligible for the above expense allotment the Officer, Chairperson, committeeperson/Steward must meet the requirements of Article VIII of these by-laws.

 

At the point the Financial condition of this amalgamated local union does not warrant the payment of the officers and committeeperson’s expenses, the membership may temporarily rescind payment o these expenses upon a majority vote and shall be reinstated by the same procedure.

 

Section 5

 

The local union shall pay a member, of any unit, lost time when the representative or member is performing necessary duties for and on behalf of that unit during a time for which he/she would be compensated by the employer. The amount of lost time should never exceed the amount which the unit union representative or member would otherwise receive from his/her employer for the same period of time for which he/she is being compensated by the local union, excluding Saturday, Sunday and or holiday unless these specific days are counted as travel days to or from the designated event. The total daily compensation shall not exceed 8 hours unless; said member is not presently in Overtime Equalization group. Seven day operators shall be compensated a maximum of 8 hours pay for any normally scheduled work day(s) served on lost time.

 

(A)Exceptions

 

Seven day operators shall be compensated a maximum of 8 hours pay for any normally scheduled work day served on lost time.

 

At any Unit where a non-traditional work schedules are implemented similar work schedules that work ten hour days or three twelve-hour work weeks. They shall be paid their regularly scheduled straight time lost time hours.

 

Section 6

 

The local union will not be responsible for any loss or damage to personal property while on or engaged in Union Business or activities.

 

Section 7

 

The office of the Financial Secretary-Treasurer shall be a Part-time position as defined in the UAW Administrative Letters.  The following schedule shall govern the pay and fringe benefits for the Financial Secretary – Treasurer.  The Financial Secretary-Treasurer will be required to work the necessary hours (shifts) in the unit facility to maintain the benefit levels provided by the contract with his/her unit, i.e. (health care, vacation, holidays, and all benefits that active employees receive under their unit’s agreements).

 

The Financial Secretary-Treasurer shall be paid their hourly base rate plus cost of living allowances (if applicable) of their unit classification at a rate of 40 straight hours per week, minus any holiday pay or hours worked. If the Financial Secretary Treasurer is a retiree the rate of pay will be $23.50. If the Financial Secretary-Treasurer has the option to work in their unit on weekends, plant shut downs, or holiday, as defined in their respective contractual agreement and eligibility per equalization grouping, they may do so at their own discretion.  The Financial Secretary-Treasurer shall receive profit sharing/bonuses based on their unit’s respective Local/Master Agreements.

 

During weeks the Financial Secretary-Treasurer receives forty (40) hours compensation (Monday-Friday) from their Unit, I.e. (vacation, holiday pay) no additional hours will be paid by the Local Union. When in the judgment of the Executive Board and/or the membership, the Local no longer requires the office of Financial Secretary-Treasurer on a Part time basis, he/she will return to their classification in their unit.

 

Section 8

 

In cases of death to the member, or someone in the member’s family, as defined under any bereavement clause in any Unit Contractual agreement, a Memorial bible will be presented to the family.  It shall be the duty of the member or member’s family to notify any officer of this local union of the death of any of the above members of his/her family.

 

Section 9

 

The fiscal year of this local union shall begin January 1 and end December 31.

 

Section 10

 

All money for recreation will be drawn from the recreation fund only.

 

All forms of recreation activities will be brought to the recreation committee which in turn will be brought before the membership.

 

Section 11

 

Unit Representatives shall designate their replacements when they are on union Business or if they are absent for any reason.  Complaints that the alternate unit representatives are not performing their duties accordingly shall be brought to the Unit Chairperson/President, who will take whatever action necessary to resolve the complaint providing the complaint has merit.

 

Section 13

 

Any member or officer, who receives lost time from their local unit and said unit is covered by profit sharing during the calendar year from January 1 to December 31 shall be compensated based on the contractual agreement.

 

Section 14

 

At each monthly membership meeting the local will provide refreshments.  Luncheons will be provided at each executive board meeting.

 

Section 15

 

The President shall be paid the highest home unit rate plus cost of living (if applicable) of their unit classification at the rate of 48 straight hours per week, minus, any holiday pay or hours worked.  If the President has the option to work in their unit on weekends, plant shutdowns, or holiday as defined in their respective contractual agreement and eligibility per equalization grouping they may do so at their own discretion. The President shall receive profit sharing/bonuses based on their unit’s respective Local/Master Agreements.

 

During the weeks the President receives forty (40) hours compensation (Monday-Friday) from their Unit, Ie. (vacation, holiday pay) no additional hours will be paid by the local union.

 

ARTICLE XI STRIKES

 

Section 1

 

Where disagreement occurs between any unit of the local union and management and the procedure for reaching a settlement with respect to such disagreement has been exhausted, the points of disagreement shall be placed before the membership of the local union and if the proposal or position of management is rejected by a 2/3 majority of those present, a motion to take a strike vote shall be in order.  All strikes shall be called or terminated only in strict conformance with Article 50 of the International Constitution.

 

Section 2

 

Upon said motion being carried, the Local Union Executive Board shall notify such governmental agencies as are required by law that a strike is pending and shall call a special meeting of the membership for the purpose of taking a strike vote by secret ballot.

 

Section 3

 

It shall be the duty of the Election Committee to arrange and prepare for a strike vote by secret ballot.  The strike vote shall be supervised by the Election Committee who shall provide for the proper polling place.

 

Section 4

 

Only members in good standing, from the effected unit, shall be entitled to vote on the question of declaring a strike.

 

Section 5

 

A two-thirds (2/3) majority of the members voting shall be required to call for a strike.  It shall then be the duty of the Recording Secretary to prepare a full statement of the matters in controversy and forward the same to the Regional Director and the International president.  No strike shall be declared or put into effect until receiving approval from the International Union.

 

Section 6

 

Before a strike shall be called off, a Special Meeting of the membership, of the effected unit, shall be called for that purpose and it shall require a majority vote by secret ballot of all members present and voting to decide the question either way.  The Election Committee shall supervise and conduct the vote on the issues of calling off the strike.

 

Section 7

 

All resources of the local union shall be available for strike purposes.

 

Section 8

 

The Strike Committee, selected by the President, shall schedule the pickets and determine the number required on the picket line at one time.  They shall otherwise provide the orderly picketing of the plant when on strike.  In all cases, the above procedure shall conform to the provisions of the International Constitution.

 

ARTICLE XII TRIALS OF MEMBERS

 

Section 1

 

All charges against a member of the Union with violations of any of the provisions of the Constitution of the International Union, or with conduct unbecoming of a member of the Union, must be made in writing with the charges clearly set forth and signed by the member making the charge.

 

 

Section 2

 

Any member accused of degrading or gossiping to the extent of discrimination against any Union business, official, committeeperson, or member of the Union shall be subjected to trial pursuant to Article 31 of the International Constitution.

 

Section 3

 

Procedures for the trial of a member and the action of a Trail Committee shall conform to the provisions of the International Constitution.

 

ARTICLE XIII CONTRACTS

 

Section 1

 

No member or officer of any unit of the local union shall have the authority to negotiate the terms of a contract without first obtaining approval of the said local union.

 

Section 2

 

Any contract negotiated between the duly authorized representatives of any unit of the local union shall, before it becomes effective and binding upon that unit, be ratified by the membership at a meeting called especially for such purpose and until such time as said contract has been approved by the International Executive Board as provided by the Constitution of the International Union.

 

 

 

 

ARTICLE XIV BY-LAWS AMENDMENTS

 

Section 1

 

The by-laws of the local union may be amended at a regular meeting of each unit or in accordance with section 3 of this article.

 

Section 2

 

Any motion to amend these by-laws must be submitted in written form and signed by the member making the motion who shall read the amendment to the membership before referring it to the President and the chairperson of the By-Laws Committee for study and recommendations.  The amendment shall be read at the next membership meeting by the By-Law Committee who shall also submit their recommendation.  If two-thirds (2/3) of the members, present and voting at such meeting, vote in favor of the amendment (with exception of attendance rules) it shall be in force and effective upon submission to the International Union.

 

Section 3

 

Special seven (7) day notice shall be given to members of the respective units of this local union of any meeting at which amendments to the By-Laws are to be voted on.  Notice shall contain article number, section number and paragraph.  These by-laws shall be in force and effect immediately upon submission to the International Union.

 

Section 4

 

The unit By-Laws Committee shall examine the By-Laws six (6) months after each Constitutional Convention, and shall submit in written form any suggested revisions at the membership meeting.  Such revisions shall be voted upon at the meeting.  A two-thirds (2/3) majority of the membership present and voting in favor of the revision shall put them in effect.

 

Section 5

 

Upon two-thirds (2/3) of the unit members present and voting at such meeting, that vote in favor of (any) new amendment the Recording Secretary shall submit by certified mail (any) new amendment(s) for approval within five (5) working days upon ratification to the UAW International Union.

 

ARTICLE XV RETIRED CHAPTER

 

That Local 723 shall provide for a Retired Workers Chapter as provided for in Article 55 of the International Constitution.

 

ARTICLE XVI        BUILDING CORPORATION

 

That this union establish a Building Corporation known as Amalgamated Local 723 UAW.

 

ARTICLE XVII LEASES AND LONG-TERM AGREEMENT

 

No agent or official of the amalgamated local union is authorized to execute a real estate lease, deed, service or maintenance contract or other long-term agreement unless the proposed agreement has been reviewed by an outside expert or attorney and approved by the amalgamated local union executive board/membership.
